1. Agreement and eligibility

These Terms of Use (“Terms”) govern your access to and use of seemotions.com, the Seemotions workspace, AI generation tools, and related services (the “Service”). By creating an account, purchasing or using credits, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy.

You must be at least 18 years old, or the age of legal majority where higher, and able to form a binding agreement. If you use the Service for a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Seemotions provides creative-production software that can route prompts, references, media, settings, and related instructions to AI models and infrastructure operated by Seemotions and third parties. Features, models, limits, prices, formats, availability, and output behavior may change as the Service evolves.

AI systems are probabilistic. Outputs may be inaccurate, unexpected, similar to outputs generated for others, or unsuitable for your intended use. You are responsible for reviewing outputs before publication, distribution, commercial use, or reliance.

3. Accounts and account security

You must provide accurate account information and keep authentication credentials secure. You are responsible for activity conducted through your account unless caused by our failure to use reasonable security safeguards. Notify us promptly if you reasonably believe your account has been compromised.

You may not sell, rent, transfer, or share an account in a way that defeats access, security, billing, or abuse-prevention controls. Automated account creation or access intended to evade limits or enforcement is prohibited.

4. Your inputs, references, and outputs

As between you and Seemotions, you retain any rights you already hold in prompts, references, uploads, project materials, and other content you submit (“Inputs”). Subject to applicable law and third-party rights, Seemotions does not claim ownership of your generated outputs merely because they were created through the Service.

You are responsible for ensuring that you have the rights, permissions, and lawful basis needed to upload and process Inputs, including photographs, likenesses, trademarks, copyrighted works, confidential material, and personal data. You must not imply that an AI-generated or edited depiction is authentic where doing so would be deceptive or harmful.

We do not guarantee that an Output is unique, non-infringing, registrable, copyrightable, or exclusively yours. Similar or identical outputs may be generated for different users. Commercial use is subject to applicable law, these Terms, the Acceptable Use Policy, and any stricter terms that apply to a model or provider used for the request.

5. Limited license needed to operate the Service

You grant Seemotions and its service providers a worldwide, non-exclusive, limited license to host, copy, transmit, transform, display to you, analyze, and otherwise process Inputs and Outputs only as reasonably necessary to provide, secure, moderate, support, debug, and maintain the Service, comply with law, and enforce these Terms.

This operational license does not give Seemotions permission to use your private project content in public marketing or to train a proprietary Seemotions generative foundation model unless we separately disclose that use and obtain any consent required by law.

6. Acceptable use and safety

You must comply with the Acceptable Use Policy. Among other things, the Service may not be used to create or facilitate child sexual exploitation, pornographic or sexually explicit material, non-consensual intimate imagery, sexual deepfakes or nudification without consent, sexual violence, serious fraud, harmful impersonation, illegal activity, or attempts to bypass safety systems.

We may use automated systems and human review to detect policy violations. A model provider may impose stricter rules than Seemotions; where that happens, the stricter provider rule governs use of that model.

7. Third-party models and services

The Service may depend on third-party AI model providers, cloud platforms, payment services, storage providers, and other infrastructure. A request may be transmitted to those providers as necessary to perform the feature you selected. Their systems may be subject to separate technical limits, safety systems, data practices, and terms.

Seemotions is not responsible for third-party services outside our reasonable control. We may disable or reroute a model when a provider is unavailable, unsafe, deprecated, or no longer commercially or technically suitable.

8. Credits, prices, and billing

Some features consume credits or require payment. Prices, credit estimates, and package details shown at checkout or before generation form part of the transaction. Generation cost can vary by model, resolution, duration, quantity, or provider.

We aim not to charge generation credits when a request is rejected by Seemotions before provider submission. Once a request has been accepted or processed by a third-party provider, provider cost may already have been incurred, including when the provider later returns a safety or processing failure. Refunds, credits, or billing corrections may be provided where required by law or where our billing system determines a charge was not validly earned.

You may not exploit billing races, duplicate-request behavior, refunds, promotions, or technical defects to obtain credits or provider usage you did not purchase or receive legitimately.

9. Enforcement, suspension, and appeals

We may block a request, remove or restrict content, limit features, suspend an account, or terminate access when reasonably necessary to protect users, providers, the Service, or third parties; comply with law; address fraud or security incidents; or enforce these Terms.

Severe violations—including child sexual exploitation, non-consensual sexual content, credible threats, or deliberate attempts to evade safety controls—may result in immediate restriction or termination. Repeated lower-level violations may result in escalating enforcement. Where required or reasonably appropriate, we may preserve evidence or report unlawful activity to relevant service providers or authorities.

If you believe an enforcement decision was made in error, you may request review through Privacy & Safety Requests.

10. Availability, changes, and beta features

We may modify, add, remove, limit, suspend, or discontinue features or models. Preview, experimental, or beta features may be less reliable and may change without notice. We do not promise uninterrupted availability or that every provider, model, output, or historical project will remain available indefinitely.

11. Seemotions intellectual property and infringement reports

The Service, software, interfaces, branding, and materials supplied by Seemotions are protected by applicable intellectual-property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service as intended; they do not transfer ownership of Seemotions technology or branding.

If you believe material processed or made available through the Service infringes your rights, submit a detailed report through the Privacy & Safety Requests page.

12. Privacy

Our Privacy Policy explains how we process personal information, including account data, user content, Google Sign-In information, safety data, provider routing, and data-rights requests.

13. Disclaimers and responsibility

To the extent permitted by applicable law, the Service is provided on an “as available” basis. We do not warrant that AI outputs will be accurate, unique, lawful for every intended use, free of third-party claims, or fit for a particular purpose. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including mandatory consumer protections that apply to you.

You are responsible for your use of Inputs and Outputs and for evaluating whether an Output is appropriate for publication or commercial deployment. Seemotions is not a substitute for legal, medical, financial, or other regulated professional advice.

14. Changes and contact

We may update these Terms as the Service changes. The effective date above identifies the current version. Where required by law, we will provide additional notice before material changes take effect.
